1. Preface
All deliveries, performances and invitations to submit an offer are subject to these terms and conditions as well as the rules and regulations. TAKEOFF24 e.U. (called TAKEOFF24 henceforth) does not accept any other terms and conditions, except if they were agreed to in writing.

 

2. Conclusion of Contract and Cancellation
TAKEOFF24 invites the contracting party to submit an offer. In the event that merchandise is not available or that information on the website is incorrect, TAKEOFF24 is not bound to accept the offer. In that event, the customer will immediately be notified that the product is not available. If the customer has already submitted payment, it will be refunded immediately. The contract of purchase is concluded at the time of shipping the merchandise. If "prepayment" is selected the contract of purchase will be concluded at the time of sending the order confirmation.

 

3. Right to Withdraw from Contract and Return Merchandise
Customers have a legal right to withdrawal. Under these terms and conditions customers are considered to be natural entities that enter into a business relationship but do not act as independent contractors or as a commercial business.

 

The customer has the right to withdraw from the contract within a 14 day period following receipt of the goods. The customer can withdraw from the contract by sending a written note (e.g. letter, email) or – if he already received the merchandise – by returning the merchandise. Giving a reason is not required. The 14 day period starts from the day of receipt of this Right of Withdrawal explanation in writing but not before the actual receipt of products by the customer. Compliance with the deadline is determined by either the sending date of the notification or the postal date of the return shipment.

Consequences of Cancellation
In the event of an effective cancellation the mutually provided goods and services shall be returned and, if applicable, any benefits enjoyed (e. g. interest) surrendered. In case the customer cannot return the received goods and services in total or in part or only in deteriorated condition, the customer has to, if applicable, provide compensation. This does not apply if the deterioration of the goods were due exclusively to their inspection - as would have been possible in a retail shop for example. The customer can avoid the obligation for compensation by not using the goods, as if they were his/her property, and by refraining from doing anything, that could impair their value. Goods that can be dispatched as parcels have to be returned at our risk.

 

Customers residing in Germany are responsible for the cost of said return, if the supplied merchandise corresponds to the ordered and if the price of the goods does not exceed 40 Euro, or in case the goods have a higher value, if the payment or contractually arranged payment installment has not yet been rendered by the customer. In all other cases, the return of the goods is free of charge to the customer. Goods that can be dispatched as parcels have to be returned at our risk. Goods that cannot be returned as parcels will be collected from your address. Obligations to return payments must be fulfilled within 30 days. For the customer this period starts with the dispatch of the declaration of cancellation or the return of merchandise. For TAKEOFF24 this period starts with the receipt of returned merchandise.

 

International customers (customers residing in any other EU country than Germany) are responsible for the cost of said return, if the supplied merchandise corresponds to the ordered. Otherwise the return is free of charge. Goods that cannot be returned as parcels will be collected from your address. Obligations to return payments must be fulfilled within 30 days. For the customer this period starts with the dispatch of the declaration of cancellation or the return of merchandise. For TAKEOFF24 this period starts with the receipt of returned merchandise.

 

In case of returns  please contact us so that we can help arrange the return. Contacting us is not mandatory to be able to withdraw from the contract. 

 

 

5. Transportation Damages
Immediately upon receipt all merchandise must be inspected by the customer. In case of damages and missing items or parts, the shipping company must be notified immediately. In the event that the box or envelope already shows signs of damage, the customer must make a note on the delivery confirmation and have the delivery person sign the note. All packaging must be kept until the issue is resolved. In the event that missing items, parts or damages cannot be seen immediately the customer has to notify TAKEOFF24 and the shipping company within 3 days of receipt of merchandise. TAKOFF24 is responsible for all shipping damages.

Warranty is provided according to legal requirements. Non-commercial customers are granted a warranty period of 24 months starting with the delivery date. If the other party is an independent contractor or a commercial business, the warranty period is 12 months. In some cases manufacturers grant extended warranty periods. Please see the product information for extended manufacturer warranty. All damages that are caused by misuse or faulty treatment of the merchandise are excluded from the warranty. Warranty is excluded for damages that are caused by normal wear and tear.

 

7. Retention of Ownership
All merchandise remains the property of TAKEOFF24 until the purchase price is paid in full.

 

8. Final Provisions, Applicable Law
For all disputes arising from contracts with commercial businesses, independent contractors and corporate bodies of any kind, the court of jurisdiction shall exclusively be the responsible court at the place of business of TAKEOFF24 e.U. in Vienna, Austria.

 

The United Nations Convention on Contracts for the International Sale of Goods does not apply.

 

The TAKEOFF24 website contains links to third party websites. We have no influence on the content of these websites. Therefore we cannot be held liable for the content of such websites. The content is the sole responsibility of the owner of the site. The sites we link to were examined for breaches of law at the time the links were set. Illegal content could not be recognized at that time. A permanent control of third party websites without evidence of violations of law cannot be reasonably expected. If it comes to our knowledge that violations of law occur on websites we link to, these links will be removed immediately.

 

In case of disputes related to the use of domains, trademarks and brand names as well as legal notices and warnings concerning E-Commerce Recht/Fernabsatzgesetz we request to be contacted before any legal steps are taken to avoid unnecessary expenses. Any costs arising out of such conflicts without previous notification will not be accepted. In case of unjustified legal notices and warnings TAKEOFF24 will put forward a counter-claim.

 

Should any individual provision of these terms and conditions be null and void, the validity of the remaining provisions hereof shall not be affected. In such cases, the invalid provisions shall be replaced by the statutory provisions.
